Under these rules, issued last September, Medicare and Medicaid would cut off payments to nursing homes that require new residents to sign forced arbitration agreements, a contract which strips individuals of their ability to sue in a real court and diverts the case to a privatized arbitration system. But last month, the Trump administration published a proposed rule which will reinstate nursing homes’ ability to receive federal money even if they force seniors into arbitration agreements. Forced arbitration can prevent even the most egregious cases from ever reaching a judge. According to the New York Times, a 94 year-old nursing home resident “who died from a head wound that had been left to fester, was ordered to go to arbitration.” In another case, the family of a woman who suffered “two spine fractures from serious falls, a large, infected ulcer on her heel that prevented her from walking, incontinence from not being able to get to the bathroom, receding gums from poor hygiene assistance, and a dramatic weigh loss from not being given her dentures,” was also sent to an arbitrator after they sued the woman’s nursing home alleging neglect. Moreover, as law professor and health policy expert Nicholas Bagley notes, arbitration tends “to favor the repeat players who hire them — companies, not consumers.” Several studies have found that forced arbitration typically produces worse outcomes for consumers and workers."

It was cruel and immoral but 100% legal. Insurance companies also set yearly and lifetime caps on coverage. Did you get HIV through a blood transfusion? Wow, that's rough. Fortunately, there are drugs that can keep it from turning into AIDS indefinitely. Unfortunately, they're very expensive and you reached your lifetime cap after 6 months. Better luck next time. Then there were pre-existing conditions, children being thrown off their parents' policy at age 18, policies that didn't actually cover anything beyond a summer cold, etc. etc. Racking up enormous medical debt was extremely easy and the United States is the only country in the world where this is a routine problem. But this is the system Republicans would like very much to return to. Trump and the GOP say they want to maintain coverage for pre-existing conditions and no yearly of lifetime caps but the system they're trying to create will bankrupt insurance companies unless they can throw people off of their coverage or raise their premiums so high they can't pay them. We can't even hold it against them because they won't have any choice but to reduce the number of people they cover. This, by the way, is the lie behind the Republican catchphrase "guaranteeing access to healthcare." Sure, you have access to healthcare, you just won't be able to pay for it. "While governing and administration have fallen by the wayside, the signs of a Trump regime are everywhere. There’s the nepotism as son-in-law Jared Kushner and daughter Ivanka Trump, who have absolutely no governmental experience whatsoever, have ensconced themselves in offices in the West Wing. There’s the cronyism symbolized most recently by the White House usher getting fired so the director of rooms at Trump’s DC hotel could get the job and son Eric’s wedding planner being tapped to run federal housing in New York City. There’s the unabashed greed as Trump (or one of his children) – on the taxpayers’ dollars – market his presidency to boost sales at his golf courses and hotel properties and arrange copyright permissions and building approvals for Trump-owned businesses in China, Argentina, and Saudi Arabia. There’s the gaslighting of the American people as his regime destroys or tarnishes alternate sources of facts, such as the media, the Census Bureau, and climate change data from government websites leaving only his regime as the authoritative dispenser of reality."

"The American Legislative Exchange Council, in thrall to large corporate interests, has set the stage for the systematic dismantling of democracy, beginning with voter suppression laws. Since the Supreme Court effectively gutted the 1965 Voting Rights Act (Shelby County vs. Holder) Jim Crow tactics have regained a hold. In 2016 Greg Palast cited at least “nine methods of attacking the right to vote of Black, Latino and Asian-American voters,” including “Caging, purging, blocking legitimate registrations, and wrongly shunting millions to ‘provisional’ ballots that will never be counted.” Prior to 2016 elections,Operation Crosscheck voter lists compiled by Kansas Secretary of State and white supremacist Kris Kobach and reportedly distributed to 29 Republican state voting officials, led to the purge of over one million registered voters who had the same first and last names. Kobach now serves as vice chair of the so-called Trump “Voter Fraud Commission” that seeks lists of all voters from every state. It would be difficult to overstate the consequences of widespread voter disenfranchisement, which should not be normalized. “Elections have consequences,” assert political operatives. "this is not exactly the kind of person we want heading up our nation’s department that enforces civil rights laws and protects the rights of minorities. By his record, we can count on him to do the exact opposite. But this seems to be the strategy of the Trump team—bring leaders into agencies that have a long career history of championing the anthesis of everything those agencies stand for. Let’s count how many agencies they’ve done this with so far: Department of Energy (does Rick Perry know anything about anything?), Department of Education (Bitter Betsy DeVos who hates poor kids), Department of Housing and Urban Development (Ben Carson—no commentary necessary), Environmental Protection Agency (Scott Pruitt—who is now launching an initiative to critique climate change) … the list goes on. This appointment will severely cripple the DOJ’s ability to do anything substantive regarding civil rights and with Jeff Sessions in charge, we know that the agency is looking to lock up and harm more people of color than ever before."
